Updated: 27 October 2026

Jan Maria Tomaszewski is the data controller and Website operator.

01General provisions

These Terms govern the use of the website showcasing the work of Jan Maria Tomaszewski (the “Website”). The Website is an informational and artistic portfolio service. The Website operator and electronic service provider is Jan Maria Tomaszewski. Contact is available through the Website contact form.

02Services and availability

Visitors may view artwork reproductions, descriptions, information about the artist and submit enquiries using the contact form. Public content is generally available free of charge without registration. The Website does not currently provide an automated online checkout or means of concluding artwork sales contracts.

03Technical requirements

Use of the Website requires internet access and an up-to-date browser supporting HTML, CSS and JavaScript. Submitting an enquiry requires completing the relevant fields. Technical safeguards may be applied to prevent automated abuse.

04Acceptable use

Visitors must use the Website lawfully and in accordance with its purpose. Disrupting the service, attempting unauthorised access, introducing malicious code, overloading infrastructure or submitting unlawful content is prohibited. Nothing in these Terms restricts rights granted by mandatory law.

05Copyright and artwork reproductions

Paintings, photographs, reproductions, texts, editorial materials and graphic elements may be protected by copyright or other intellectual property rights. Copyright in Jan Maria Tomaszewski’s artworks belongs to the respective rights holders under applicable law. Artwork and graphic reproductions are displayed to showcase the artist’s work. Their publication does not grant a licence to download, reproduce, print, publish, distribute, modify, use in advertising, sell or otherwise commercially exploit them. This also applies to use on social media, in press materials and digital publications, subject to statutory exceptions. Attribution and rights notices must not be removed. Statutory exceptions and permitted uses remain unaffected. Licensing enquiries should be addressed to the Website operator.

06Permissions for reproduction and publication

Any permission to reproduce, publish, supply artwork images to the press, or use them for exhibitions, promotion or commercial purposes should be agreed in advance with the relevant rights holder, including scope, permitted uses, duration, territory and attribution requirements, unless the use is independently permitted by law. Crediting the artist or linking to the Website does not replace permission where required. Licensing enquiries may be submitted through the contact form.

07Artwork information and no binding offer

Dimensions, techniques, dates and descriptions are provided for presentation purposes. Unless expressly stated otherwise, displaying an artwork does not constitute a binding offer within the meaning of Article 66 of the Polish Civil Code or a guarantee of availability for purchase. Any sale, licensing or collaboration terms require individual agreement.

08Contact and correspondence

The contact form is intended for enquiries about artworks, exhibitions and collaborations. Sending a message does not conclude a contract, reserve an artwork or oblige the operator to make an offer. Unlawful, spam or irrelevant messages may be disregarded. Personal data processing is described in the Privacy Policy.

09Operation and liability

The operator endeavours to maintain the Website but temporary interruptions may occur due to maintenance, updates or failures. Published information may be corrected. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

10Complaints about electronic services

Issues concerning the operation of the Website and complaints about electronically supplied services may be sent to the Website contact form. A complaint should describe the issue and provide sufficient information for a response. Complaints will be handled without undue delay and in accordance with mandatory legal time limits.

11Privacy and cookies

Information on personal data processing, visitors’ rights and cookies is set out in the Privacy Policy and Cookie Policy linked in the Website footer.

12Applicable law and amendments

The applicable law is Polish law, without prejudice to mandatory consumer and other protective provisions. These Terms may be updated for legitimate reasons, including changes to Website functionality or applicable law. The current version and revision date are published on the Website.
